FWC GenAI document requirements now apply to Commission cases

From 20 October 2026, Fair Work Commission requirements cover disclosure and verification when GenAI helps prepare case documents. The guidance was announced in August.

The Commission announced its guidance on 24 August 2026, with application from 20 October. Parties using GenAI to prepare case documents must explain its use, personally check accuracy and relevance, and verify genuine evidence and legal authorities. Witness statements and declarations must reflect the witness’s own knowledge and words. Read the detailed guidance for its scope and exceptions.

NORMIX practical takeaway: add a submission check covering AI disclosure, source verification, confidentiality, witness confirmation and authorised human review. Keep the checked version and supporting records. These are requirements for Commission proceedings; they are not a general rule governing every recruitment algorithm. This article records a commencement milestone, not a newly published October law.
