Discrimination law: investigate AI selection and access decisions
Discrimination law: investigate AI selection and access decisions. Existing laws in force. Check coverage for each AI use case.
AI screening, ranking and eligibility tools require investigation of the actual decision criteria and affected people. A supplier’s fairness claim does not establish that a particular recruitment, tenant or service decision complies with applicable discrimination law.
Use-case investigation: identify protected attributes and proxy variables, validation samples, accessibility, reasonable adjustments, human review and complaint routes. Preserve the decision rationale and testing evidence. Select the applicable Act and section for the actual setting before confirming a baseline; this article is an investigation guide, not a finding that all unequal outcomes are unlawful.
